Here, once you file your divorce papers and have them served to the ex – it takes about 30-45 days to get into court. A judge may or may not order support at that time – it might take longer because both sides have to do their financials and some ex’s drag their feet on that – to the point where the judge finally gets mad enough about it and could order them in contempt.

But, here again, support would probably not be ordered on a marriage of only 4 years. More like 10 years here and then it would be about 1/2 the length of the marriage. AND, here we have what is called the “Sullivan Act” and that’s where an ex who’s been supporting someone they’ve been putting through school and can ask for half of the future earnings for when the student gets a job in their field. This is especially true for those spouses who put their spouses through law school or medical school.

And the permanent resident situation – I think I heard that they have to be here 3 years married before that immigration situation comes into play. But, I’m no attorney – so all this is on friend’s experiences.
