Taking the decision to divorce usually follows when one or both spouses have left a marriage and want to move forward with a new partner. When most marriages end, most couples are just happy to have time apart from what has become a battle zone or cold front. Top of the agenda for any couple when a marriage ends is to sort out arrangements, custody and maintenance for any dependent children. Following this, the separated spouses must prepare for the paper chase – signing over house deeds, opening and closing bank accounts, changing passport names and so on – when it comes to ending a marriage the paper chase is one of the most time consuming tasks!

Clients often ask if a Florida “Easy Divorce” is attainable. Of course it is – whenever both husband and wife can agree to make the process work. A Florida “Easy Divorce” will not be possible if one of the parties wants to make things difficult. Just like every other state, Florida has mandatory rules that have to be met in order to be awarded a divorce. There is just no getting around this.
It can be asked, how might one of the spouses obstruct the Florida “Easy Divorce”? By contesting matters which need to be consented to, including divorce grounds, or in contesting matters including (a) how the property will be divided, (b) how the children’s residence will be decided & when each parent will have parenting time, or (c) how much child support should be remitted under the law.
People ask whether a California “Easy Divorce” is possible. Sure it is – when both parties will work together to expedite the process. A California “Easy Divorce” will not be completed when the husband or the wife wants to dispute any of the issues. Just like other states, California has set rules that have to be followed before you can get a divorce. This fact is unavoidable.
Clients ask, how is it possible for one spouse to impede a California “Easy Divorce”? They can do so by arguing about issues, such as grounds for divorce under circumstances where grounds are required to be agreed on, or by choosing to dispute issues such as (a) what property to divide, (b) who the children will live with & how custodial time will be divided, or (c) how to determine if alimony ought to be given the situation.
All issues that have to be addressed prior to getting a California divorce can also be argued about. So, if you or your spouse wants to delay & halt an “Easy Divorce”, it can be done.
Divorce is a painful and extremely difficult process. Knowing how divorce laws function and understanding the court’s role in a divorce can help to make this transition smoother and easier, however.
Divorce laws govern the dissolution of a marriage. Every country has its own laws regarding divorce and, in fact, divorce laws can vary from state to state or province to province within a nation. I am in the state of Florida and someone told me recently they filed their own divorce papers and didn’t have to go through a lawyer to do it. I’m not sure if there were children involved or not. Must you have a lawyer to file for divorce or can it be done on your own and yes, there is one child involved in this divorce. If you can do it on your own, any idea what steps to take or where to start?
