I recently heard from a wife who had come up with a strategy that she hoped would get her husband’s attention and make him recommit to her marriage. She was considering serving him with divorce paper in order to “scare him” into saving the marriage.

She said, in part: “my husband is very noncommittal about saving our marriage. He seems to always be on the fence. He has no sense of urgency at all and always tells me that he wants to “wait and see” what happens. I want to be very proactive and work very aggressively on saving our marriage and getting the passion back. My husband will admit that we have problems. He will admit that we need to do something. But he isn’t sure what he wants that “something” to be. He’s mentioned separation, a break, or a divorce, but he never mentions doing any real work to make our marriage better. I’m just thinking that if I force his hand a little bit, he may be scared or alarmed enough to actually work with me.”

Marriage was November 2002, Bell County Texas. Lasted 2 months at most. They have not seen or spoken to each other since then. He does not know where to find her for her to sign papers. He also does not live in Texas but in Michigan. What is the proper way to file for a divorce? Can it be done without a lawyer?

She filed divorce papers on 4-20-09 Thank God! I gave her the house I just got, along with everything in the house. I only want my two big screen tvs and my stereo. She’s asking for me to pay a debt to small claims. That is our only dispute of property. No kids involved. How long is it till I am FREE?

The short answer is yes. The court can order that one spouse be removed from the marital residence while the other spouse can be granted exclusive possession of the marital residence. In practicality, the process and end result is not nearly that simple.

If you are the one who wants to stop a divorce you will have to convince your spouse to give the relationship another try.  This sounds completely logical but it is the very first simple fact you have to understand.  Of course it isn’t always possible to convince your divorce minded spouse to give the relationship another try but it is imperative if you want any chance of stopping a divorce.  You can stop a divorce at any stage, such as just before the paperwork is filed or even just before the paperwork is approved by the courts.  But the earlier you stop a divorce the more likely that it won’t be brought up again.

To reiterate, convincing your spouse to give your relationship another go around is the very beginning process to stop a divorce.  But this does not mean continuous begging to your spouse.  If you have been doing that it is time to stop.  You may be thinking that you need to do a lot of begging to get the point across as if the more begging the more it will wear down their resistance.  The chances are, your begging is just getting more on their nerves and making them want the divorce even more.  No one wants to be around someone who seems to be unsure of themselves or needy.

can you send it in the mail by way of certified letter? He lives in a different state them me (I live in WI & he lives in MN). It costs too much for me to have the sheriff to serve him. He is willing to do anything for me for the divorce so I didn’t know if sending in the mail would work.
With a certified letter HE has to sign the paper that says he got the letter so there would not be reason to have to pay someone. Since I don’t have a lot of money I would rather save it for use on my children. So as long as there is proof that he received the papers that should be all I need?

husband and wife lving together with 3 kids– he wants divorce, she will not leave–when can he file for divorce? do they have to be living separately 30 days?

I have resided in TX for almost 2 yrs. Need a simple way to get this divorce over and done without having to hire a lawyer.
